DFL: via news release from the House DFL last night, about the swearing-in ceremony, VERBATIM: “Last week we publicly stated our reasons for denying quorum – we would like Republicans to honor the will of the voters,” said DFL Speaker-designate Melissa Hortman. “We're working to successfully conclude negotiations with House Republicans and remain hopeful that we will have a power-sharing agreement before Tuesday, January 14th. Denial of quorum is a legitimate parliamentary tactic. Michigan House Republicans used the same tactic in December 2024. In the event Democrats choose to deny quorum, we wanted to be sure to have all our members properly and legally sworn in and we did that this evening.”…There are multiple instances of representatives being sworn in at a time other than the first day of session. Minnesota statute 3.05 does not provide that the first day of session is the only time that members can be sworn in. Other Minnesota law and past practice indicates it is legally permissible to be done at other times and that it has been done at other times. Other law provides the persons entitled to administer oaths, and Democrats followed those statutes today.”
TAKE: It’s a high-stakes political risk-reward calculation by House DFLers and other DFLers (in the Senate) are concerned that it will impact them as well. While 2026 is political light years away, the calculation is risky. It’s also messy. The lawyers and “wanna be” lawyers on X and elsewhere can argue legality – but we’re following the politics. Are there consequences? Between the end of last Session, and the start of this one, the D in DFL could stand for “dysfunction”. That said, DC has had dysfunction for years and incumbents keep getting re-elected.

MN SENATE: via an MN Senate press release, VERBATIM: “Today, leaders from the Senate DFL and Republican caucuses announced they have reached an organizing agreement to govern the work of the Senate during the temporary tie before the Senate District 60 special election. The agreement will be passed as a resolution on the Senate floor on Tuesday, January 14, the first day of the 2025 session. … Each caucus leader will appoint a co-presiding officer; caucus leaders will agree who will convene each day. Each committee has joint chairs, with gavel sharing determined by the chairs [and] equal representation of DFL and GOP members on committees. … The agreement [will be] in place until there are 34 votes to end the agreement.”

● MURPHY: “Sen. Mitchell, by asking to continue her trial [after session], is acting in her self-interest as an individual and a legislator, and that is her right. However, we saw last session how the Republicans used her pending court case as a way to disrupt the work of the Senate. I have been looking forward to the resolution of her case. The Senate DFL Caucus is ready to get back to the work of the people of Minnesota.”
● JOHNSON: “Sen. Mitchell’s [request] further delays an orderly Senate session. … The Senate cannot tell the judiciary what to do, but we can and should hold our own members accountable. Senate Republicans stand by our previous votes to not allow her to vote, to not count her vote, and to remove her from the body. QUORUM: Sec. Steve Simon sent a letter to House Leaders Melissa Hortman and Lisa Demuth on Friday explaining his rationale for why he thinks a legislative quorum requires 68 members. MPLS GOP: In response to the quorum standoff, the Minneapolis GOP has begun publishing material that encourages constituents to call their DFL representative and tell them to resign. DIVISION: Speaking to the Star Tribune, former Rep. Gene Pelowski (D-Winona) said he doesn’t think the partisan division in the Minnesota state legislature will improve anytime soon. There was a time when there would be Republicans and Democrats who were moderates and who could come together…and get things done or stop things that shouldn’t happen. TOMORROW: Minnesota native Pete Hegseth and former North Dakota Gov. Doug Burgum will undergo confirmation hearings for their cabinet positions on Tuesday. In central time, Hegseth’s hearing is at 8:30 a.m. and Burgum’s is at 9:00 a.m.
WEDNESDAY: Former South Dakota Gov. Kristi Noem will have a confirmation hearing for her cabinet position on Wednesday at 8:00 a.m. central.
