On Sunday Take House Leaders Lisa Demuth and Melissa Hortman were guests to discuss the upcoming legislative session, which is scheduled to begin tomorrow. LISTEN: https://fluence-media.co/3DOnWD0
TAKE: The House is broken.Yesterday was a day that Minnesota’s governing dynamic changed – potentially forever. Just like the rules of the US Senate, and the debate over a filibuster the culture of the House as an institution changed. The actions of the DFL not showing up, and the GOP refusing to seat Rep. Brad Tabke are a depth of discord that may be unrecoverable for a decade or more. The Senate shows signs of hope; however, action will be the real indicator rather than opening week warm fuzzies. Leader Hortman has doubled down on the denial of quorum as a political strategy, but it’s not Minnesota. Republicans denying an election, shouldn’t be surprising given the acceptance of Trump’s election loss denial.
Remember, we were different – but we’re not anymore. What DFLers underestimate is the depth of the distrust and feelings about bad policy that it passed during the trifecta. The accessibility and openmindedness of the members has changed. For DFLers they don’t even meet with or dialog with people they disagree with, for Republicans they come from a wing of the GOP that isn’t mainstream.
DFL members have been dismissive of basic questions about their trifecta agenda and costs. The test for Republicans is, can they stay united and disciplined to build a winning agenda in Minnesota during the Trump midterm?
The test of Gov. Tim Walz ability to authentically work with, and not dismiss or insult Republicans will be one thing to watch. The other is does the Senate, find a more moderate tone with a bipartisan budget proposal? The House had leverage, but the behavior this week, should make every member look in the mirror and ask who they are serving.
TOMORROW: DFL House Leader Melissa Hortman said Gov. Tim Walz’s state budget proposal is expected to be released this Thursday.
WALZ: via New York Times, VERBATIM: “Since returning to Minnesota after a failed bid for vice president, Gov. Tim Walz has kept a relatively low profile. He consoled deflated supporters with a speech at a high school, posed for photos with a turkey at the Minnesota State Capitol to mark Thanksgiving and flew to the Bahamas for a brief respite from the cold. This week, Mr. Walz, a Democrat, must start grappling in earnest with his party’s sinking political fortunes in his home state as lawmakers begin meeting in St. Paul for what is expected to be an unusually acrimonious state legislative session.” READ: https://fluence-media.co/427OlpD
SD60: The primary for the Senate District 60 special election concluded last night, with the full contest coming two weeks later on Jan. 28. The district leans left, so the winner of yesterday’s DFL primary is likely to become the next state senator. Results are summarized below:
DFL PRIMARY:
· Doron Clark wins with 38.1% (2,073 votes)
· Monica Meyer nets 34.6% (1,882 votes)
· Peter Wagenius nets 23.22% (1,262 votes)
· All other candidates got 4% (219 votes)
GOP PRIMARY:
Abigail Wolters wins with 72.2% (153 votes)
Christopher Robin Zimmerman nets 27.8% (59 votes)
See the Secretary of State’s website for more details. RESULTS: https://fluence-media.co/42d1cqq
SUPREME COURT: Sec. Steve Simon announced plans to file a petition with the state Supreme Court regarding the start of the legislative session, asking the court to “make clear to the public that these proceedings were not legally legitimate.” Simon determined that quorum was not met yesterday and adjourned the House, but Republicans reconvened the session without him — an action Simon calls illegitimate because his authority was “violated.” SIMON: “I anticipate that the courts will provide clarity both on [quorum] and on the understanding that the person who holds the Secretary of State’s office is the presiding officer until a Speaker is legally elected — an event which has not yet occurred.” READ: https://fluence-media.co/3DRXA3h
MORE: via House Session Daily, VERBATIM: “DFL speaker-designate Melissa Hortman (DFL-Brooklyn Park) expects lawsuits to be filed directly to the Minnesota Supreme Court contesting the Republicans’ actions, and she hopes for rulings on an expedited basis.” HORTMAN: “What I expect is that the Minnesota Supreme Court would find that the Minnesota House was not duly organized today [and] the sham session violated Minnesota state law. … Given Republican statements this morning indicating their intent to ignore the election results, [House] Democrats have no other recourse to protect the will of the voters than to deny quorum.” READ: https://fluence-media.co/42dGbMg
MORE: via WCCO Radio, VERBATIM: “What happens next [is] not immediately clear. The No. 2 Republican leader, Rep. Harry Niska, told reporters that the GOP was prepared for a legal challenge. He said [Sec. Steve] Simon, as a member of the executive branch, is barred by the constitutional separation of powers from controlling the work of the House, and that he is confident the Minnesota Supreme Court will agree, even though all of its justices were appointed by Democratic governors.” READ/LISTEN: https://fluence-media.co/3DWqejC
WATCH: One thing to watch for is if Secretary of State Steve Simon tries to convene the House at 3:30 to test quorum today.
MN HOUSE: via MPR News, VERBATIM: “DFLers on Tuesday made good on their threat to keep the Minnesota House in limbo, boycotting the session’s opening as the parties fight over control. House Republicans responded by pushing ahead in the half-empty chamber. … [After] GOP members were sworn in…[Sec. Steve] Simon, in his role as the initial presiding officer, declared there was no quorum [and] gaveled the session adjourned for the day. After a brief break, however, [Republicans] rose to override Simon’s ruling [and] unanimously chose their leader, Rep. Lisa Demuth, R-Cold Spring, to be House speaker. … It’s not clear what comes next, but all of it is likely headed for legal challenges.” READ: https://fluence-media.co/3DTYBI2
RESPONSE: via a Rep. Lisa Demuth statement, DEMUTH: “House Republicans are ready to get [to] work. … I am deeply honored to serve as Speaker of the House, and look forward to working with all of my colleagues in the House, the Senate, and Governor [Tim] Walz to do the work Minnesotans sent us here for this session. While I'm disappointed Democrats failed to follow state law by refusing to show up for work, I'm confident we can still work together for a productive session.” READ: https://fluence-media.co/42go2NY
MORE: via a Gov. Tim Walz statement, WALZ: “As much as House Republicans may want to govern as a single party, the law is the law and the House is not in session. House Republicans need to assure Minnesotans that they won’t overturn an election or take power voters didn’t give them. Once that common sense commitment is made, the important work that the House has in front of them can move forward.” READ: https://fluence-media.co/4h032zB
DEAL: Via KARE 11’s John Croman, House DFL Leader Melissa Hortman told reporters yesterday that the deal she offered to her GOP counterpart Lisa Demuth during last-minute negotiations was to temporarily support Demuth as a full Speaker until the House is tied again — but only if Republicans explicitly agreed to seat Rep. Brad Tabke in House District 54A. Hortman said Demuth wouldn’t take this deal, which is similar to the current power-sharing agreement in the tied Senate. It’s unclear when or if negotiations will continue. TWEET: https://fluence-media.co/4gSIQjf
MN SENATE: via Pioneer Press, VERBATIM: “Meanwhile, the state Senate operated more smoothly on its opening day Tuesday. DFL and Republican caucuses in the Senate, which is temporarily tied 33-33, [had] reached a power-sharing agreement. Under the agreement, they elected Sen. Bobby Joe Champion, DFL-Minneapolis and Sen. Jeremy Miller, R-Winona, as ‘Co-Presiding Officers.’ They also split Senate committee seats between the parties and appointed co-chairs. Democrats are expected to reclaim a majority in the Senate in a few weeks [following] the special election on Jan. 28.” READ: https://fluence-media.co/4jcCZql

TABKE: via MPR News, VERBATIM: “Judge Tracy Perzel ruled that state Rep. Brad Tabke won the Minnesota House race in the Shakopee area. … In her ruling, Perzel said that sworn testimony from voters believed to have cast the missing ballots showed that it was mathematically impossible for [Republican Aaron Paul] to have pulled ahead in the race. … Republicans have suggested that they will not seat Tabke, regardless of a ruling in his favor. The Minnesota Constitution says that the Legislature has the final say in determining who is a member. … [But] Democrats have threatened [continuing] to boycott the start of the session if GOP leaders refuse to accept Tabke’s win.” READ: https://fluence-media.co/4jf8LTK

MITCHELL: via KSTP, VERBATIM: “Defense [attorneys] for Woodbury DFL State Sen. Nicole Mitchell on Tuesday argued before a Becker County Judge that her burglary trial should be delayed until after the 2025 legislative session ends in May. The judge did not make a decision on whether or not to delay the trial. He’s taken the arguments under advisement and said he will make a decision when he is prepared. As of now, Mitchell’s trial is scheduled for the end of the month. Mitchell attended the hearing remotely as the legislative session began in St. Paul.” READ/WATCH: https://fluence-media.co/4h9BYhD
BONDING: via MinnPost, VERBATIM: “Disappointed in a 2024 legislative session that ended with no bonding bill, Greater Minnesota organizations are encouraging the Legislature to focus on funds for infrastructure projects. … The Coalition of Greater Minnesota Cities and the League of Minnesota Cities [plan] to push lawmakers to pass a bonding bill, which would allow the state to borrow funds for local projects. … Ideally, that legislation would pass early in the session, said Bradley Peterson, executive director of the CGMC. ‘This is unfinished business from last year,’ he said.” READ: https://fluence-media.co/3WfoEjd

DHS: via news release from the House GOP, VERBATIM: “Representatives Kristin Robbins (R-Maple Grove) and Jeff Backer (R-Browns Valley issued a joint statement following the resignation of the Minnesota Department of Human Services (DHS) Commissioner, Jodi Harpstead, citing ongoing challenges and calls for stronger accountability within the department. QUOTE: "The resignation of the DHS Commissioner underscores the significant challenges facing the Department of Human Services and is a direct result of Republicans pushing for more oversight. For years, DHS has been plagued by operational failures, mismanagement, lack of transparency, and fraud,” said Robbins. Rep. Backer continued, “Minnesotans deserve a government that is both accountable and effective in delivering critical services. This change in leadership offers an opportunity to address longstanding issues and rebuild trust with the public." MORE: https://fluence-media.co/3PAQQcE
HEGSETH: via MinnPost, VERBATIM: “[Minnesota native] Pete Hegseth deflected tough questions and firmly defended President-elect Donald Trump during his hearing as the nominee for defense secretary Tuesday. … Hegseth defended himself on a range of controversial issues, including a sexual assault allegation and allegations of heavy drinking. … Democrats [questioned] his lack of management experience and comments he has made and written against women serving in combat. Republicans on the Senate Armed Services Committee, who hold a slim 14-13 majority on the panel, lauded Hegseth and asked him softball questions [like] ‘how many pushups can you do?’ … After the hearing, [Hegseth] seemed poised to be voted favorably out of the committee.” READ: https://fluence-media.co/42fPPye
ENROLLMENT: via Star Tribune, VERBATIM: “A national research firm apologized [for] inaccurate data that showed college freshman enrollment nationally and in Minnesota decreased last fall, when in fact it increased. … Many Minnesota higher education officials had questioned the data in December, saying it didn’t match the increasing enrollment they were seeing within the state. DEEPFAKES: An ongoing lawsuit regarding First Amendment protections for AI-generated “deepfakes” in Minnesota saw the plaintiffs’ request for a preliminary injunction denied in District Court last week. Via Forum News Service, Rep. Mary Franson (R-Alexandria) filed the lawsuit against Attorney General Keith Ellison last fall, claiming Minnesota’s ban on “deepfakes” is a violation of the First Amendment right to free speech. Per the judicial order, District Judge Laura Provinzino has now ruled that “because [Franson] fails to demonstrate that she will be irreparably harmed absent injunctive relief, she is not entitled to that determination at this time.” ORDER: https://fluence-media.co/3WiIpWY BACKGROUND: https://fluence-media.co/4ajt66j

SUBURBS: via Star Tribune, VERBATIM: “On the edge of the Twin Cities suburbs, clusters of homes along major roads give way to big lots with long driveways and plenty of elbow room. … A Metropolitan Council proposal would encourage more dense development in cities along the suburban fringe — and it’s not going over well everywhere. … Advocating for the higher density standard, Met Council Member Peter Lindstrom listed lower greenhouse gases, better access to jobs, higher transit viability and less pollution runoff from road salt, among other benefits. … But in a letter to the council, Lino Lakes Community Development Director Michael Grochala called the proposal a ‘one-shoe-fits-all’ approach to communities' density requirements.” READ: https://fluence-media.co/4hgdeUw
